1. Acceptance of Terms
By accessing or using PayslipMate Australia ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.
2. Description of Service
PayslipMate Australia provides an online tool for generating payslip documents for Australian employees. Our service calculates PAYG income tax, Medicare levy, superannuation, and HECS-HELP repayments based on the information you provide.
Important: PayslipMate is a document generation tool. We are not an accounting firm, payroll service provider, or registered tax agent. The payslips generated are based solely on the information you enter.
3. Intended Use
Our Service is intended for:
- Small business owners creating payslips for legitimate employees
- Sole traders and self-employed individuals documenting their income
- Employers providing pay statements as required by the Fair Work Act 2009
- Individuals keeping accurate personal payroll records
You may NOT use our Service for any fraudulent, illegal, or deceptive purposes, including but not limited to creating false income documentation for loan applications, visa applications, or any other purpose where the information does not accurately reflect actual employment and earnings.
Creating, distributing, or using falsified payslip documents may constitute offences under the Criminal Code Act 1995 (Cth), including obtaining a financial advantage by deception (S.134.2) and general dishonesty offences (S.135.1), as well as offences under the Crimes Act 1914 (Cth). Penalties may include imprisonment of up to 10 years. Employers creating false payroll records may also incur civil penalties under the Fair Work Act 2009.
4. User Responsibilities
You are responsible for:
- Ensuring all information entered is accurate and truthful
- Verifying calculations meet your specific requirements
- Maintaining the confidentiality of your account credentials
- Complying with all applicable Australian federal and state laws, including the Fair Work Act
- Keeping copies of your payslips for your records
5. Tax Calculation Disclaimer
While we strive to maintain accurate tax calculations based on the latest ATO (Australian Taxation Office) PAYG tax tables, we cannot guarantee 100% accuracy for every situation. Complex tax scenarios, special exemptions, working holiday maker rates, or other unique rules may not be fully captured.
For official tax filings, payroll remittances, or complex situations, consult a registered tax agent or qualified accountant.
6. Payment Terms
- Your first payslip is free with no credit card required
- Additional payslips require payment at our current rates
- All prices are in Australian Dollars (AUD) and include GST where applicable
- Payments are processed securely through Authorize.net
- By making a purchase, you authorise us to charge your payment method
7. Refund Policy
Please see our separate Refund Policy for details on refunds and cancellations. In general:
- Digital products (payslips) are non-refundable once downloaded
- Unused credits may be refunded within 30 days of purchase
- Technical issues will be resolved or refunded at our discretion
8. Intellectual Property
The Service, including its original content, features, and functionality, is owned by PayslipMate Australia and is protected by Australian and international copyright, trademark, and other intellectual property laws.
You retain ownership of the data you input. The generated payslip documents are licensed to you for your personal or business use.
9. Limitation of Liability
To the maximum extent permitted by Australian law (including the Australian Consumer Law), PayslipMate Australia shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages
- Any errors in tax calculations or document generation
- Loss of profits, data, use, or other intangible losses
- Any unauthorised access to or use of our servers
- Any consequences arising from your use of generated documents
Our total liability shall not exceed the amount you paid us in the 12 months prior to the claim. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee under the Australian Consumer Law.
10. Indemnification
You agree to indemnify and hold harmless PayslipMate Australia and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
11. Account Termination
We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms, is harmful to other users, or is harmful to our business interests.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New South Wales, Australia, and the Commonwealth of Australia, without regard to conflict of law provisions.
13. Dispute Resolution
Any dispute arising out of or relating to these Terms shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within 30 days, either party may pursue legal remedies in the courts of New South Wales, Australia.
14. Changes to Terms
We reserve the right to modify or replace these Terms at any time. Material changes will be posted on this page with an updated date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
15. Law Enforcement Cooperation
We reserve the right to cooperate with law enforcement authorities, including the Australian Federal Police and state police services, and comply with court orders requesting or directing us to disclose information about users suspected of fraudulent or illegal activity. We may retain user data beyond our standard retention period when required for fraud investigations or legal proceedings.
